Introduction
Tail of Chaos is a trading name of Sphere Media Technologies Co Ltd, a company registered in Mauritius (“Tail of Chaos”, “we”, “us”, “our”). These Terms govern your use of our website and any order you place with us. By placing an order or using our website, you (“you”, “the customer”) agree to be bound by these Terms. If you do not agree, please do not use our website or place an order.
Definitions
- Artwork” means the original hand-painted canvas, and any digital reproduction of it, created for your order.
- “Order” means a request for a personalised Artwork placed and paid for through our website.
- “Content” means any photograph, description, name, or other material you submit to us for use in creating your Artwork.
- “Products” means the Artwork and any additional items — such as mugs, prints, cushions, or phone cases — featuring a reproduction of your Artwork.
Orders & Payments
Orders are placed through our website, https://tailofchaos.com. Full payment is required at checkout. We do not process an order, or allocate it to an artist, until full payment has been received.
Prices are shown in Mauritian Rupees (MUR) and are inclusive of VAT. The VAT amount included in your order is shown separately at checkout. We reserve the right to correct pricing errors, and to refuse or cancel any order at our discretion, including where we suspect fraud, misuse, or where fulfilling the order is not reasonably possible.
Personalisation & your Content
To create your Artwork, you provide us with a photograph of your pet, a description of the scene, and any details about people, characters or props to be included (“Content“). By submitting Content, you confirm that:
- you own the photograph, or otherwise have the right to share it with us;
- where your Content includes an identifiable person other than yourself, you have that person’s consent to use their likeness in the Artwork, or, if they are a minor, the consent of their parent or guardian; and
- your Content does not infringe any third party’s rights and does not include anything unlawful, offensive, or inappropriate.
You grant us a licence to use your Content solely to create, produce, and deliver your Artwork and any Products you order. We may decline to use Content we reasonably consider unlawful, offensive, or otherwise inappropriate, and may ask you for alternative Content before proceeding with your order.
Our commitment to original, hand-painted artwork
Every Tail of Chaos Artwork is individually hand-painted by one of our artists. No part of the sketch or painting process uses artificial intelligence image-generation tools. Each piece is an original work created specifically for you — we do not use templates.
The Creative Process
Once your order is allocated to an artist, we will send you a pencil sketch of the proposed composition for your approval. You are entitled to one free revision of the sketch; further revisions may incur a fee. Once you approve the sketch, the artist will paint your Artwork.
Minor touch-ups are available if the finished Artwork deviates materially from the approved sketch, as set out in the Returns, Revisions and Refunds Policy (Clause 8). We do not repaint an entire canvas once the sketch has been approved.
Collection (pick up)
All orders are collected in person from Tail of Chaos Studio, Helvetia, Moka, Mauritius. We do not ship any products. Once your order is ready, we will contact you to arrange collection. Please inspect your order carefully at the time of collection, as set out in Clause 8 below.
Intellectual Property
The copyright in each Artwork is owned by the artist who created it and is exclusively licensed to us for commercial reproduction and use. When you purchase an original canvas, you own the physical canvas, but you do not acquire the copyright in the Artwork or any right to reproduce it. We do not provide digital files or high-resolution scans of your Artwork.
You may display your canvas privately and personally. You may not reproduce, copy, print, or commercially exploit the Artwork, or any photograph of it, without our prior written consent and that of the artist.
Public Display & Exhibition
We may wish to feature your Artwork in our marketing, on our website or social media, or in a public exhibition. We will only do so with your prior written consent, which we will request separately from these Terms. You are free to decline without affecting your order.
Acceptable Use
You must not use our website for any unlawful purpose, attempt to gain unauthorised access to our systems, or submit Content that is fraudulent, defamatory, or infringes the rights of others. We may suspend or refuse service to anyone who breaches this clause.
Limitation of Liability
To the fullest extent permitted by law, our total liability to you in connection with any order is limited to the amount you paid for that order. We are not liable for any indirect, incidental, or consequential loss. Nothing in these Terms limits any liability which cannot be limited under Mauritian law.
Indemnity
You agree to indemnify us against any claim, loss, or cost arising from Content you submit, or from your breach of these Terms.
Privacy & Data Collection
We collect and use personal data — including photographs, names, and contact details — to process and fulfil your order, in accordance with the Data Protection Act 2017 (Mauritius). We do not sell your personal data. Artists working on your order have access only to the Content necessary to complete it, and are separately bound to keep it confidential and not to contact you directly.
Force Majeure
We are not liable for any delay or failure to perform our obligations caused by circumstances beyond our reasonable control, including illness, natural disaster, cyclone, or civil disruption. We will notify you and provide a revised timeframe where reasonably possible.
Changes to these Terms
We may update these Terms from time to time. The version in effect at the time you place your order will apply to that order. Continued use of our website after changes are posted constitutes acceptance of the updated Terms.
Governing Laws & Disputes
These Terms are governed by the laws of Mauritius. Any dispute will be referred first to mediation before legal proceedings.
